Sales Terms and Conditions

Goods are purchased via this site on the following terms and conditions. 

Services purchased from our service suppliers are provided upon the terms and conditions of business of our service suppliers individually.  Check their websites for details.

Goods purchased from other sites via links from this site are purchased on the terms and conditions set out on those other sites and we are not in any way responsible for them or for any contract concluded there.

Sales of Goods made via this Site

1. Parties to the Contract

This website and The Toddler Learning Store is not the seller of any goods purchased via this website.

The seller (whom we shall now call “Seller”) of each item is identified in the online catalogue under the picture for each item.  When you press a buy now button and proceed to check out you are making an offer to purchase the goods from that Seller.  A contract does not come into existence until the Seller has accepted the offer from you by email acknowledging receipt and acceptance of your order.  If you have included items from more than one Seller in your basket then you are making separate offers to the various Sellers and will have a separate contract with each Seller who accepts your offer.  In this case you will receive an email from each.  For the avoidance of doubt, acknowledging receipt of your order is not the same as acceptance of your order and it is possible for one Seller to accept your offer and for another Seller not to.

2. Price

All prices are quoted in pounds Sterling and are inclusive of VAT unless otherwise specified.
Prices are subject to any changes to the rate or applicability of VAT
All item prices are exclusive of delivery and packaging, unless otherwise stated. Details of our delivery charges are found in the "Postage" and “Handling” sections of our catalogue.
Prices are correct at the time of order only and relate to internet purchases only.
Payment must be made in pounds Sterling only by major credit or debit cards or by means of your Paypal account.
All orders, even those using a payment card, will be processed by Paypal who are providing us with their secure online payment collection service.  We and our Sellers do not have access to your card details or bank information other than what is necessary to process your order and deliver the goods. We will pass this information to each Seller.
All orders for goods are subject to availability.
Our Seller’s reserve the right to refuse to supply any particular person.

3. Payment

To ensure that there are sufficient funds to pay for your order Paypal debits the required amount from your account. If your order is not accepted, the Seller will advise Paypal and Paypal will release your funds back to you. You will normally receive the refund within 4-5 days.

4. Ownership of the Goods

Our Sellers will retain ownership of the goods until full payment has been made by you and has been received by us.

5. Passing of Risk

The risk in the goods will pass to you on delivery.

6. Delivery

Any date or period for delivery quoted on this site or in any email between you and the Seller will be considered as indicative only, although it is our Seller’s policy to try to fulfil standard delivery orders within 4 working days and named day deliveries on the specified day. Standard delivery orders containing items weighing more than 20 kilograms or to remote or rural addresses might take longer to deliver. Our Sellers cannot be held responsible for delays in the delivery caused by their suppliers, or any other third party.
The method of delivery will depend upon the Seller.
You bear the risk once the goods have been signed for/delivered.

7. Acceptance of the Goods

You will inspect the goods within a reasonable time after their receipt and you will be deemed to have accepted them unless you notify the Seller in accordance with paragraph 8 below that you want to cancel your order or you notify the Seller in accordance with paragraph 9 below that the products are faulty. If you do not either cancel or notify us that the goods are faulty, then our Seller will consider you to have accepted that the goods are as described, are of satisfactory quality and fit for their purpose, and may not accept any rejection or cancellation at a later date. Your statutory customer rights are not affected.

8. Right to Cancel

You have the right to cancel your contract with the Seller at any time before the expiry of 7 working days from the day after the date of delivery of the goods.  To cancel, you must send an email to the Seller at the Seller’s email address listed on our Seller’s Contact Page.   If you cancel, it is still your responsibility to take reasonable care of the goods until our Seller has arranged for them to be collected or they have otherwise been received by the Seller. If you exercise this right to cancel, you will receive a full refund of the purchase price and any postage or handling. Your statutory rights are not affected.

9. Exceptions to the right to cancel

There are some exceptions to this right to cancel and the Seller may have a different policy in effect:
• Video games, CDs, DVD’s and Videos will only be accepted if the packaging has been unopened and the security seal is still intact.
• Items which have been made, personalised or customised specifically for you.  For these items refer to each Seller for details of their cancellation policy.You will find their email address listed on our Seller’s Contact Page
Your statutory rights are not affected.

10. Faulty Items

Items faulty on delivery

Any item that was faulty at the point of sale may be returned for free repair, replacement or refund, provided you have the original receipt or alternative proof of purchase and the faulty item is returned complete with all components. 
For items to be returned more than six months after the time of purchase the same above applies but in addition, evidence of fault at the time of sale will be required.
Please note that you will not be entitled to a repair, replacement or refund in respect of fair wear and tear. Please return the original and complete packaging.

Faults covered by a warranty

If any of the goods come with a warranty and they develop a fault within the warranty period assistance will be provided by way of spares or a repair depending on the type of product purchased. Wear and tear is not covered by the manufacturer’s warranty.

12. General

Goods sold on this site are only available in mainland United Kingdom and Northern Ireland and, as such, may be unavailable in the region or country from which you are accessing the Site.
Some products may not available for delivery in Northern Ireland. Exceptions will be notified to you when the Seller determines whether or not to accept your purchase offer.
Any age recommendations and suitability on the site are a guide only, including video game titles displaying an age certification classified by the Entertainment & Leisure Software Publishers Association (ELSPA). Video game titles displaying an age certification classified by the British Board of Film Classification (BBFC) cannot be purchased by anyone under the certified age.
If any part or parts of these terms and conditions are deemed invalid, void or unenforceable, then that part or those parts will be considered severable from these terms and conditions thereby not preventing the remainder from being enforceable or effective.
These terms and conditions may be revised at any time and we reserve the right to do so. You are, therefore, advised to keep up to date with the contents of these terms and conditions as revisions are binding upon you.
Nothing in these terms and conditions will reduce your statutory rights relating to faulty or misdescribed goods. For further information about your statutory rights contact your local authority Trading Standards Department or Citizen's Advice Bureau.

13. Governing Law

Your use of this Site and any purchase of any goods by you via this Site will be governed by English Law as a contract made in England, even if you are resident elsewhere.
